Deferred Disposition

Read Carefully!

Deferred Disposition is a 90 or 180 day probationary period giving you the opportunity to keep the violation off your driving record. If you meet all the requirements upon completion of your Deferral, your case will not be reported on your driving record and the Judgment will show dismissed.

If you are eligible, you must make your request by the initial appearance date on your citation. The defendant shall complete and sign the appropriate paperwork.(See form below)
Once the court receives the request, copy of valid Texas Driver's License, and paper copy of proof of Liability insurance, the formal order will be mailed to you to sign and return with your payment by the end of the 30 days.

Reasons for Ineligibility

Committed one of the following offenses:

(A) Failure to Give Information at Accident Scene;
(B) Leaving scene of accident;
(C) Fleeing or attempting to elude police officer;
(D) Reckless driving;
(E) Passing a school bus;
(F) A serious traffic violation;
(G) An offense in a construction maintenance zone when workers are present;
(H) Speeding 25 mph or more over limit;
(I)   Offense involving Alcohol or Tobacco
(J)  Offense involving Assault,  Disorderly Conduct or Theft
- or for one of the following reasons...
(a)  Is in "Pending Warrant" or "Active Warrant" status
(b)  Hold a Commercial Driver's License;
(c)  The citation resulted from a traffic accident;
(d)  A second or subsequent offense of Failure to Maintain Financial Responsibility

Moving and Non-Moving Charges

Deferred period will be for 90 days

  • Must pay an expense fee and court costs within 30 days
  • Must not be charged with any similar offenses during your deferral period
  • If a Moving Violation and you are under 25 years of age, you must attend a driving safety course and return the certificate of completion to the court

No Driver's License Charge

Deferred period will be for 90 days

  • Must provide proof of a valid Driver's License
  • Must pay the expense fee and court costs within 30 days of request
  • Must not be charged with any similar offenses during your deferral period

No Liability Insurance Charge

Deferred period will be for 180 days

  • Must show proof that you obtained Liability Insurance by initial appearance date
  • Must pay the expense fee and court costs within 30 days of request
  • Must not be charged with any similar offenses during your deferral period
  • Must provide proof that insurance was enforce for the entire 180 days without a lapse in coverage
