An appearance in court is by mail, in person or by attorney. A phone call does not constitute an appearance. Failure to appear in court as required by law may result in being denied the renewal of the driver’s license and assessment of an additional fee.
Indicate your plea in the proper space provided on the reply form. A plea of nolo contendere means that the defendant does not contest the State’s charges filed against them. The fine for a nolo contendere plea is the same as that for a plea of guilty. Either plea indicates that the defendant agrees to waive an appearance before the Court for trial. Refer to the fine schedule to determine the total amount of the fine(s) acceptable by the Court.
Make remittance payable to LACY LAKEVIEW MUNICIPAL COURT. Return a copy of the citation along with the Municipal Court Plea Form and remittance to assure proper credit. Acceptable forms of payment are cash, money order, and credit card/debit card. No checks accepted.
To request a trial, indicate on the reply form and return no later than 20 business days from the date of your citation. Also, the defendant should indicate if they want a trial before the Court or before a Jury. The defendant will be notified by the Court of the trial date by mail.
PLEASE NOTE: The Judge cannot discuss the merits of a pending judicial proceeding prior to the trial. Return the copy of the citation along with the Municipal Court Plea Form.
Under the laws of the State of Texas, the defendant may be eligible to have one moving violation within a 12-month period dismissed by taking a driving safety course. HOWEVER, THE DEFENDANT WILL LOSE THAT RIGHT IF THEY DO NOT PROVIDE WRITTEN NOTICE TO THE COURT OF THE DESIRE TO DO SO ON OR BEFORE THE APPEARANCE DATE SHOWN ON THE CITATION. The defendant will not pay the fine unless they fail to complete all requirements.
Defendants are not eligible for this option if:
At the time of request, the defendant will be required to submit a copy of their valid Texas driver’s license and proof of financial responsibility and pay fees.
If you are unable to pay, you must contact the court to discuss alternative means of payment.
JUVENILES younger than 16 MUST APPEAR IN OPEN COURT FOR ALL PROCEEDINGS ACCOMPANIED BY A PARENT OR GUARDIAN BY THE APPEARANCE DATE ON THE CITATION. JUVENILES MAY NOT USE THE REPLY FORM TO MAKE THEIR APPEARANCE. A JUVENILE WHO FAILS TO APPEAR AT THE TIME AND DATE ON THE CITATION MAY HAVE THEIR LICENSE SUSPENDED AS REQUIRED BY LAW AND MAY BE TURNED OVER TO THE JUVENILE JUSTICE COURT FOR PROSECUTION.
